VEVY EUROPE S.p.A. PRIVACY POLICY

This Privacy Policy illustrates what personal data are, what types of personal data Vevy Europe S.p.A. collects, for what purposes these are collected, how they're processed and what rights a user has about this subject matter. Vevy Europe S.p.A. guarantees the user that its data will be carefully processed.

Vevy Europe S.p.A. ("also indicated as "we", "our") is a joint-stock company under Italian laws, with head office in Genoa in via Padre Semeria 16A, VAT code IT00269300109.

PROCESS OF PERSONAL DATA

1. Personal data: definition

Personal data are intended as any information associated to an identified or identifiable person (hereunder also indicated by "user", for example: contact information, the data concerning its orders, its interests (anyway related to our products and our activities), its requests and, more generally, any other personal information given to us.
For the purpose of this document the following are not considered as "personal data":

  • not personal, but anonymous data (ex., aggregated and/or statistical data);
  • data of authorities / legal persons / enterprises.

2. General criteria of Vevy Europe S.p.A. to process personal data

When processing personal data, Vevy Europe S.p.A. sticks to the following principles:

  • only collects personal data for legitimate, explicit, and specific purposes (in any case these purposes shall be related to the products and activities of Vevy Europe S.p.A.);
  • does not collect additional personal data that are different from the necessary ones to reach these purposes;
  • it neither uses nor will use any personal data for any purposes that are different from those for which these data have been collected, except for provisions indicated in this information, or after additional specific consent;
  • Vevy Europe will not share or transfer any personal data to third parties, with the exception of provisions in this information, or after additional specific consent;
  • it undertakes and will undertake to guarantee that all information is updated, while asking from the present time the user to periodically verify its personal data;
  • it guarantees and will guarantee organizational, technical and practical measures that are suitable to protect and safeguard the personal data of users against illegal or accidental destruction, or accidental loss, modification, disclosure or not authorized access and against any other illegal process;
  • except for the before-stated provisions, Vevy Europe will not retain the above-mentioned data for a longer time than the one necessary to reach the purpose for which these data have been collected and processed, or for which these have been additionally processed, or in compliance with the law provisions.

3. Personal data Vevy Europe S.p.A. collects and processes

When a user interacts with Vevy Europe S.p.A. through various channels – including our website - some personal data may be collected and processed. Any possible personal data, collected and processed by Vevy Europe S.p.A., may be catalogued as follows:

Any personal details, such as name, email address, physical address (if given), telephone number (if given) and language.

  • The information concerning the formulated requests, shown interests, performed purchases, the name of the company for which a user acts, the information concerning delivery (for example the address for delivery), the physical address, the information concerning an order, such as: name of a product, quantity, identification code of a warehouse, number of series of a product, quantity, date of purchase, information concerning payment.
  • any requests for customer assistance and technical support, including the above specified personal details, other important information Vevy Europe S.p.A. may require to deal with any requests of a user.
  • information given during completion of surveys, questionnaires and forms of opinion, for example: personal details, as above specified, any information concerning one's position.
  • Any information collected during sessions of physical meeting with corporate premises or elsewhere.

4. How Vevy Europe S.p.A. uses the personal data of users - Purpose of data processing

Vevy Europe S.p.A. collects and processes the personal data, if applicable, to give users with information concerning news (also scientific ones), events, activities, researches, and like contents related to Vevy, its products. Data processing by Vevy Europe S.p.A. in this connection will be based upon the related user consent.

Therefore, some personal data of users may be first collected and then processed, to allow Vevy Europe S.p.A. to perform contract obligations towards users, for example, when a user purchases some products, contacts assistance department. If a user resolves not to give Vevy Europe S.p.A. with the required personal data that are necessary in this connection, Vevy Europe S.p.A. could not be able to fully satisfy the request of this user.


5. Place of recording and process of users' data by Vevy Europe S.p.A.

As a general rule, users' personal data shall be recorded and processed within the European Economic Area (SEE).

In case of transfer of users' personal data to any third country, as defined in the General Regulation about Data Protection (GDPR), Vevy Europe S.p.A. undertakes to comply with law and regulations in force concerning these transfers and to guarantee the related legal and security protection measures before this transfer. Through the specially provided e-mail address: Privacy@vevy.com it is possible to send a request or application to know assured guarantees, as well as means to obtain copy of these data or the place where they are available.

Personal data are processed by manual and automated devices, by modalities that are strictly related with the above-mentioned purpose (possibly also by profiling or by comparing the same data) and, in any case, security, protection and confidential nature of data are guaranteed.


6. Disclosure of personal data of users' by Vevy Europe S.p.A.

As a general rule, Vevy Europe S.p.A. collects and processes data to facilitate services or to improve products, perform activities of research and innovation on own products, increase its services or offers.

Vevy Europe S.p.A. neither sells and/or spreads users' personal data nor it shares these data with third parties, except in the extent stated in this Privacy Policy.

Vevy Europe S.p.A. only may spread personal data of users to third parties in the extent as required by law, because of an order of a court or resolution pronounced by a public authority having jurisdiction and with the aim to enforce laws.

In the end Vevy Europe S.p.A. may share personal data of users, with the following third parties:

  • the resellers authorized by Vevy Europe S.p.A., to supply users with products and services, to guarantee a consistent level of service for products and services, while improving them;
  • its suppliers and, more generally, the third parties that perform services for and on behalf of Vevy Europe S.p.A., including invoicing, sales, marketing, computerized support, advertising, analysis, research, customer assistance, assistance for products, fulfilment of an order of purchase and shipment, recording data, confirmation, security, fraud prevention, processing payments and legal services. These third suppliers have access to data to provide these services, but they may not use users personal data for other purposes;
  • third parties to define, exercise or defend the legal rights of Vevy Europe S.p.A.;
  • third parties in case of any merger, sale, joint venture, disposal, transfer, or other provision for all activities or actions of Vevy Europe S.p.A. or of part of them;
  • other third parties that are subject to additional and different consent by users.

When Vevy Europe S.p.A. communicates user data to a third party (in compliance with the above-stated provisions) it adopts all reasonable measures to ensure that these third parties are bound by obligations of confidentiality and of Privacy for what concerns the protection of personal data.

This disclosure happens in compliance with the regulatory obligations including the drawing-up of agreements concerning data processing with third parties, the guarantee that personal data are processed according to our directions, laws and rules in force and for the purposes specified by Vevy Europe S.p.A. and to guarantee adequate security measures.

Third subjects belonging to the above-stated categories will use the received data in their capacity of autonomous data controllers, except for the case in which they have been designed by Vevy Europe S.p.A. as "processors" for the processes of their specific competence.

Within Vevy Europe S.p.A. the following categories of people may learn some personal data: as appointees or processors - employees, collaborators for any reason (for example: attached people, unpaid trainers, para-subordinates) and non-resident collaborators, as well as, resident and non-resident structures performing - for and on behalf of Vevy Europe S.p.A., technical, supporting tasks.


7. Retention of personal data

Vevy Europe S.p.A. retains users' information - on computerized and/or papery support - for periods that are no longer than the necessary ones for the purpose for which these information are collected. The time period which Vevy Europe S.p.A. retains information depends on the purposes for these information have been collected and used. Each interested party may ask Vevy for information about duration of the process that concerns it, while acting according to the provisions of the following paragraph 18.

9. Data controller

Vevy Europe S.p.A., with head office in 16131- Genoa, Italy, via Padre Semeria 16A, VAT code IT00269300109, is the controller of users' personal data. Resident controller for the processes performed by Vevy Europe S.p.A. andpro-temporelegal representative, domiciled for its functions with the legal head office of the Company.

10. Access by user to its personal data and portability of data

Any user has right to access and receive the personal data that concern it, given to Vevy Europe S.p.A. in a simple, structured format, of common use, this format shall be electronically readable; and a user has the right to send these data to any third party selected by it.

11. Updating and deletion of users' personal data

User is required to update its own personal data provided to Vevy Europe S.p.A. in any time in which personal data are modified.

As for any information concerning mode of contact, please read section 17.

To guarantee that user personal data , processed by Vevy Europe S.p.A. are updated, Vevy Europe S.p.A. may resolve to ask user to verify them and, if necessary, update them one time per year at least.

On request of the interested party, user personal data may be erased from the servers of Vevy Europe S.p.A. except in the case in which Vevy Europe S.p.A. has rights or is obliged by laws and regulations in force to keep and to process these information independently from the withdrawal of this consent.

After deletion, users personal data will be removed from the servers of Vevy Europe S.p.A. without unjustified delays; while, because of the specific technologies used to guarantee data integrity, longer timer is necessary to guarantee complete deletion of any information item that still could be recorded in back-up of Vevy Europe S.p.A.

A user may contact Vevy Europe S.p.A. to again see, update or erase its recorded personal data.

12. Rights of a user to withdraw its consent

Any user has the right to withdraw its consent to the process made by Vevy Europe S.p.A., of personal data.

The withdrawal of the consent by a user will not jeopardise the lawfulness of the process that already was made before withdrawal.

In case of withdrawal of the consent by users, Vevy Europe S.p.A. (and any involved third parties, according to above-mentioned provisions) will interrupt processing users personal data, except for and exclusively to the extent in which the continuation of this process or of recording is allowed or required in compliance with the applicable laws concerning personal data, or other applicable laws and regulations.

Please remark that, as an effect of the withdrawal of the consent by the user, Vevy Europe S.p.A. might not be able to meet users requests or to supply the related services and information.

13. Rights to limit a process and rights to refrain

A user has the right to limit to process own personal data:

  • if its personal data are not correct;
  • if Vevy Europe S.p.A. no more needs personal data for the purpose of the process, but if recording these data are required by user to enforce, exercise or defend any rights;
  • if user raised objections concerning process and verification whether Vevy Europe S.p.A. still has a pending lawful interest for these personal data;

Any user also has the right to formulate objections concerning processing own personal data for direct marketing purposes and/or of scientific information.

In any moment any user has the right to raise objections against processing its own personal data that have been collected and processed for lawful interests purposes pursued by Vevy Europe S.p.A.

14. Rights of complaint

If a user wants filing a complaint concerning a Privacy breach, to know information concerning the contact mode, please look at section 17.


15. Websites, plug-in and services of third parties

Websites, apps of Vevy Europe S.p.A. can contain links to websites, plugs-in of third parties; for example, plug-in to access social media, or services.

Subject to consent, Vevy Europe S.p.A. may disclose or spread user information to the above-mentioned third parties. Vevy Europe S.p.A. is not responsible or liable for contents or practices of these websites, plugs-in or services. The collection, use and disclosure of user personal data shall be subject to Privacy Policies of these third parties and not to the present one. Therefore, users are requested to carefully read Information documents about Privacy and about security of third parties.

16.DataSecurity

Vevy Europe S.p.A. is engaged to protect the security of user personal data.

Vevy Europe S.p.A. adopts necessary organizational, technical and administrative measures to protect user personal data such as the monitoring of access, transmission, input and availability, in addition to data separation.

Any personal details (therefore not commercial ones) and those related to users' credit cards, if a user provided them to Vevy Europe S.p.A. , will remain encrypted in the servers of Vevy Europe S.p.A. Information concerning credit cards are sent to one or more certified and approved suppliers of services and may not be recorded for longer time than the one necessary for data processing. All transmissions towardsouternet, of personal data, facilitated by Vevy Europe S.p.A., are protected by cryptography.

If any user occurs to decide that its interaction with Vevy Europe S.p.A. is no longer safe (for example if it notices that the security of any account it could have with us was breached ), we ask it to timely communicate the problem by contacting Vevy Europe S.p.A.

Please note that, before agreeing and fulfilling the requests of an interested party, Vevy Europe S.p.A. shall activate specific procedures and a proper verification of the identity of the submitting party of a request or application.

After having obtained full information that is necessary to meet the request, the established deadline to process requests are 30 days. This period may be extended by additional 60 days, if necessary, according to the corporate activities of Vevy Europe S.p.A., to complexity and to the number of requests. In any case this extension shall be communicated within first 30 days from the time in which all information has been obtained.

If any user is not satisfied with the outcome of this complaint or management of its own complaint by Vevy Europe S.p.A., this user may submit its complaint to the Guarantor for the Protection of personal data, according to the modalities that at present are stated in the site:www.garanteprivacy.it .


18. Variations of the Privacy Policy by Vevy Europe S.p.A.

Vevy Europe S.p.A. may modify or update the present document according to needs to reflect variations of products and services of Vevy Europe S.p.A., any modifications of applicable laws, regulations or practices, and itmay process feedback of customers.
Therefore, we invite users to periodically read the Privacy Policy. The date of last updating always is quoted in the upper part of the document.

Should Vevy Europe S.p.A. substantially modify this, it will inform users by publication of a notice or by sending a communication.

Italian Data Protection Authority provides the following preliminary description of Cookies:

Profiling Cookies

Profiling cookies are aimed at creating user profiles. They are used to send ads messages in line with the preferences shown by the user during navigation. In the light of the highly invasive nature of these cookies vis-à-vis users' private sphere, Italian and European legislation requires users to be informed appropriately on their use so as to give their valid consent.
